Overview

Welcome to Pickled Tink.

These Terms of Service explain the terms that apply when you visit our website, place an order with us or otherwise use our products and services.

In these Terms, “we”, “us” and “our” refer to Pickled Tink Limited. “You” and “your” refer to the person using our website or purchasing from us.

Pickled Tink Limited is a company registered in England and Wales under company number 12822482. Our registered office is 38 Eton Wick Road, Eton Wick, Windsor, Berkshire, SL4 6JL.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.

By using our website or placing an order with us, you agree to these Terms together with any policies referred to within them, including our Privacy Policy and Delivery & Returns Policy.

Nothing in these Terms affects your statutory rights as a consumer.


1. Using our website

You may use our website for lawful purposes and for your own personal use.

If you create an account with us, you are responsible for keeping your account details and password secure and for ensuring that the information you provide is accurate and up to date.

You must not misuse our website, attempt to gain unauthorised access to it, introduce viruses or malicious software, interfere with its operation, extract or reproduce content without permission, or use it in a way that infringes the rights of another person.

We may suspend or restrict access to our website if we reasonably believe it is being misused.


2. Our products

We take reasonable care to describe and photograph our products accurately.

However, many Pickled Tink products are handmade, personalised and made using natural materials, so there may be small variations between the product shown on our website and the product you receive.

Natural wood

Wood is a natural material. Grain pattern, colour, knots and other natural characteristics will vary from piece to piece.

These differences are part of the character of natural wood and do not normally constitute a fault.

Handmade and hand-finished products

Small variations may occur as a natural result of making and finishing products individually.

These may include minor differences in wood grain, paint finish, engraving, positioning or other handmade details.

These variations should not materially affect the overall design, quality or function of the product.

Colours

We make every reasonable effort to display product colours accurately.

However, colours may appear differently depending on your screen, device settings, brightness and lighting. For this reason, the colour displayed on your screen may vary slightly from the colour of the physical product.

Measurements

Product dimensions shown on our website are approximate unless expressly stated otherwise.

Small variations may occur as a result of the handmade nature of our products.

We may make minor changes to the construction or materials of a product where necessary to improve its quality, safety or availability, provided those changes do not materially alter the product you ordered.

We may also change or discontinue products, colours, finishes or options from time to time.


3. Personalisation

Many Pickled Tink products are made specifically for you using the personalisation details supplied when you order.

3.1 Checking your personalisation

You are responsible for checking that all names, initials, dates, wording, spelling, punctuation and other personalisation details entered when placing your order are correct.

Please also check that you have selected the correct product, colour, finish, design, size and other product options.

We will normally make your product using the information and options supplied with your order.

Please check your order confirmation carefully after ordering and contact us as soon as possible if anything is incorrect.

3.2 Changes after ordering

Please contact us as soon as possible if you need to change your personalisation or another part of your order.

We may be able to make changes if production has not started, but changes cannot be guaranteed once your product is being made.

3.3 Personalisation layout

The exact layout or sizing of personalised wording may vary depending on the number of characters, names or other information supplied.

We may make reasonable adjustments to font size, spacing or positioning where necessary to ensure that the personalisation fits the product and remains visually balanced.

Any character limits shown on a product page form part of the design requirements for that product.

If you require personalisation outside the options or character limits shown, please contact us before ordering.

3.4 Customer errors

We cannot accept responsibility for errors where a product has been made correctly using the information supplied with the order.

This may include:

  • spelling or punctuation errors;
  • incorrect names, initials, dates or wording;
  • incorrect product, colour, finish or design selections; or
  • other incorrect information or options supplied when ordering.

This does not affect your rights where we have made the error or where the product is otherwise faulty or not as described.


4. Custom orders and customer-supplied content

Where we agree to create a custom product or design outside our standard website options, the specifications agreed between us will form part of your order.

If you provide photographs, graphics, logos, artwork, wording or other material for use in a personalised product, you confirm that you have the necessary permission to use that material and to authorise us to reproduce it for the purpose of fulfilling your order.

You must not provide material that is unlawful, infringes another person's intellectual property rights or is defamatory, threatening, discriminatory or otherwise unlawful.

We may refuse or cancel an order containing material that we reasonably believe falls into one of these categories.

If we cancel an order for this reason before producing it, we will refund the amount paid for the cancelled item.


5. Orders

When you place an order through our website, you are offering to purchase the products shown in your order.

After ordering, you will receive an order confirmation using the contact details you provide.

Please ensure that your email address, delivery address, personalisation details and product selections are correct before completing checkout.

We may refuse or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable;
  • there has been an obvious pricing or description error;
  • we cannot fulfil the requested personalisation;
  • payment has not been authorised;
  • we reasonably suspect fraudulent activity or misuse of the website; or
  • fulfilling the order would be unlawful.

If we cancel an order after payment has been taken, we will refund the relevant amount.


6. Changes and cancellations

6.1 Cancelling within 24 hours

We allow orders to be cancelled within 24 hours of being placed.

To request a cancellation, please contact us through our contact page and include your order number.

After 24 hours, we may already have started making your personalised product and cancellation will no longer normally be possible.

Any approved refund will be issued to the original payment method.

6.2 Personalised products

The normal statutory right to cancel an online purchase because you have changed your mind does not apply to goods that are made to your specifications or are clearly personalised.

This includes products made using names, initials, dates, wording or other bespoke personalisation supplied or selected when the order was placed.

Once our voluntary 24-hour cancellation period has passed, personalised or custom-made products cannot normally be cancelled, returned or refunded simply because you have changed your mind.

This does not affect your rights where a product is faulty, damaged, misdescribed or has been made incorrectly by us.


7. Non-personalised products

Where a product has not been personalised or made to your specifications, your statutory cancellation rights may apply.

For qualifying online purchases, you normally have 14 days after receiving the goods to tell us that you wish to cancel.

Once you have told us that you wish to cancel, the goods should normally be returned within a further 14 days.

Please contact us before returning anything so that we can provide the correct return instructions.

Unless the product is faulty, incorrect or not as described, you will normally be responsible for the cost of returning it.

You may inspect the product as you would reasonably be able to do in a shop. We may reduce a refund where the value of the product has been diminished by handling beyond what is reasonably necessary to inspect it.

Any refund due will be issued to the original payment method within the applicable statutory timeframe.

Where required, this will include the cost of our standard delivery option originally paid. If you chose a more expensive delivery service, we are only required to refund the equivalent cost of our standard delivery option.

8. Faulty, damaged or incorrect products

Every Pickled Tink order is carefully checked before dispatch, but please contact us if your product:

  • is faulty;
  • arrives damaged;
  • is not as described;
  • is the wrong product;
  • does not match the options ordered; or
  • contains a personalisation error made by us.

Please provide your order number and, where possible, clear photographs showing the problem.

Photographs help us assess and resolve problems quickly, particularly where an item has been damaged in transit, but providing photographs does not remove or reduce your statutory consumer rights.

We will review the issue and arrange an appropriate solution. Depending on the circumstances and your legal rights, this may include a repair, replacement, price reduction or refund.

Where an item needs to be returned because it is faulty, damaged, incorrect or not as described, we will provide return instructions and cover the reasonable return cost.

Your rights in relation to faulty or misdescribed goods are protected by the Consumer Rights Act 2015.

Nothing in these Terms limits those rights.


9. Prices and payment

All prices shown on our website are in pounds sterling (£) unless stated otherwise.

The price payable is the price shown when you place your order, subject to the correction of obvious errors.

Any applicable delivery charges will be shown before you complete checkout.

Prices, offers and promotions may change from time to time. Changes will not affect orders that have already been accepted unless there has been an obvious pricing error.

Promotional offers may have their own terms. Where promotion-specific terms conflict with these Terms, the terms of the relevant promotion will apply.

You agree to provide accurate and complete payment and billing information when placing an order.

Payment is processed using the payment methods made available at checkout.


10. Dispatch and delivery

Our products are handmade and/or finished to order.

Our current standard dispatch time is 3–5 working days, unless otherwise stated on our website.

Dispatch time is the time required to make, personalise and prepare your order. It does not include the time your parcel spends with the delivery provider.

Working days do not include weekends or bank holidays.

Delivery options, charges and estimated delivery times are shown at checkout and in our Delivery & Returns Policy.

Delivery estimates are provided in good faith but are not guaranteed delivery dates unless we expressly agree otherwise with you.

Occasionally, a delivery provider may experience delays outside our direct control. If this happens, please contact us in accordance with our Delivery & Returns Policy and we will investigate.

Where we arrange delivery, the goods remain at our risk until they are delivered into your physical possession or to another person identified by you to receive them.

If a parcel is confirmed missing, we will take appropriate steps to resolve the matter, which may include sending a replacement or providing a refund where appropriate.


11. Delivery information provided by you

You are responsible for providing a complete and accurate delivery address.

If you notice an error in your delivery address, please contact us as soon as possible.

We may be able to update the address if your order has not yet been dispatched, but changes cannot be guaranteed once the parcel has entered the delivery network.

If an order is returned to us because the delivery address supplied was incomplete or incorrect, or because delivery could not be completed for a reason attributable to the recipient, we may ask you to pay the reasonable cost of sending the order again.

This does not apply where failed delivery was caused by us or our chosen delivery provider.


12. Intellectual property

Unless otherwise stated, the content of the Pickled Tink website and our original product designs, photographs, graphics, text, branding and other original materials belong to Pickled Tink Limited or are used by us under licence.

You may access and use our website for personal, non-commercial purposes.

You must not reproduce, copy, distribute, sell or commercially exploit our protected content without our prior permission, except where permitted by law.

Third-party names, trademarks, graphics and other intellectual property remain the property of their respective owners.


13. Reviews, photographs and feedback

If you choose to send us feedback, submit a review or upload photographs through a review service or another feature of our website, you remain responsible for the content you submit.

You must not submit material that is unlawful, defamatory, threatening, abusive, misleading or that infringes another person's rights.

Where you voluntarily submit a review, photograph or other content for publication, you give us permission to display and reproduce that content for purposes connected with operating and promoting Pickled Tink, subject to applicable privacy and data protection law and any choices provided by the relevant platform.

We may remove content from our website where we reasonably believe it is unlawful, inappropriate or infringes another person's rights.


14. Third-party services and links

Our website may contain links to third-party websites or use services provided by third parties, including payment providers, delivery providers, review services and ecommerce tools.

We are not responsible for the content, availability or privacy practices of third-party websites that we do not control.

If you choose to use a third-party website or service, its own terms and privacy policies may apply.

Nothing in this section limits any responsibility we have for third parties we use to fulfil our obligations to you where the law makes us responsible for their actions.


15. Shopify

Our online store is hosted by Shopify.

Shopify provides the ecommerce technology that enables us to display products, process orders and provide other website functionality.

Your contract for the purchase of Pickled Tink products is with Pickled Tink Limited, not Shopify.

Personal information processed through our Shopify store is handled in accordance with our Privacy Policy and, where applicable, Shopify's own privacy arrangements.


16. Privacy

Information about how we collect, use, retain and share personal information is contained in our Privacy Policy.

Please read our Privacy Policy for further information about how your personal information is handled.


17. Errors and website availability

We take reasonable care to keep the information on our website accurate and up to date.

Occasionally, however, information may contain typographical mistakes or other errors relating to matters such as product descriptions, prices, availability, promotions or delivery information.

We may correct genuine errors when they are discovered.

If an error materially affects an order you have already placed, we will contact you and, where appropriate, give you the opportunity to continue with the corrected order or cancel it for a refund.

We do not guarantee that the website will always be available without interruption, although we will take reasonable steps to maintain it.


18. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms limits or excludes:

  • your statutory rights as a consumer;
  • liability for death or personal injury caused by negligence;
  • liability for fraud or fraudulent misrepresentation; or
  • any other liability that cannot legally be excluded or limited.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Our products are supplied primarily for private and domestic use.


19. Events outside our reasonable control

We will not be responsible for delays or failures caused by events genuinely outside our reasonable control, such as severe weather, major transport disruption, industrial action, widespread service outages or other exceptional events.

Where such an event affects your order, we will take reasonable steps to minimise the effect and keep you informed where appropriate.

This does not affect any statutory rights you may have.


20. Changes to these Terms

We may update these Terms from time to time to reflect changes to our products, services, website, business practices or legal requirements.

The Terms that apply to an order will normally be those in effect when that order was placed.

The current version will be available on our website together with the date on which it was last updated.


21. Severability

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed to the extent necessary.

The remaining provisions will continue to apply.


22. Waiver

If we do not immediately exercise a right available to us under these Terms, this does not mean that we have waived that right.


23. Governing law

These Terms and any contract between you and Pickled Tink Limited are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, nothing in these Terms is intended to remove any mandatory consumer protections or rights available to you under applicable law.
